Terms of Service

These Terms of Service ("Terms") govern your use of Create Your Song, an AI-powered song-creation service operated by Roman Bagaiev, a sole proprietor registered in Poland (jednoosobowa działalność gospodarcza), and available through a Telegram bot at https://t.me/create_your_song_bot and the website muzsong.com. By using the service you agree to these Terms.

1. Operator and Contact

The service is operated by Roman Bagaiev, sole proprietor (jednoosobowa działalność gospodarcza), Poland. NIP: 8961648195. REGON: 540828577. Business address: [business address to be added].

Contact: support@muzsong.com. The service is available through the Telegram bot at https://t.me/create_your_song_bot and the website muzsong.com.

2. The Service

Create Your Song generates songs from the text prompts and options you provide. A successful song generation produces two MP3 files together with cover artwork, delivered as either a vocal song or instrumental music, through the Telegram bot.

The service also includes AI text assistance for preparing song details, a public library of public song pages, options to make songs private, removal of watermark or branding for eligible users, and saved AI-generated vocal profiles where supported.

Create Your Song uses third-party AI and infrastructure providers, which may include OpenAI and music-generation services accessed through third-party API providers. These providers may change over time, and their processing of your inputs and outputs is subject to their own terms.

3. Eligibility, Account, and Recovery

Your Create Your Song account is tied to your Telegram user account. You must be at least 13 years old, or the age of digital consent in your country if higher, to use the service.

Users who have not reached the legal age of majority in their country may use the service only with the permission and supervision of a parent or legal guardian.

You are responsible for keeping your Telegram account secure. If you lose access to your Telegram account, recovery of your account and balance is not guaranteed.

You may contact support, and we may attempt a manual transfer on a best-effort basis. We may require proof of purchase and of account ownership, and we may refuse a transfer where we have security or fraud concerns.

4. Tokens, Subscriptions, Payment, and Billing

Generation is paid for with tokens. Generating one song costs 12 tokens; regenerating a song costs a further 12 tokens. Additional AI text assistance actions beyond the included allowance cost 1 token each, and tokens may be used for other paid features offered in the bot. The token cost of each feature is shown before use.

Tokens purchased in one-time packs do not expire while the service remains active and your account is in good standing.

If Create Your Song is discontinued or the token system is materially changed, we will aim to provide reasonable prior notice and an opportunity to use remaining purchased tokens, where reasonably possible.

Subscriptions include a monthly allowance of tokens and premium features and renew automatically each month until cancelled. Premium access continues until the end of the period you have already paid for. Unused subscription tokens remain available for 30 days after cancellation. If a subscription renewal payment fails, premium access and premium features may be suspended until payment succeeds.

Tokens are a prepaid, internal accounting unit. They are not money, electronic money, a payment instrument, or a store of value, and cannot be exchanged or redeemed for cash.

Payments are handled by Paddle. Under Paddle's current Buyer Terms, Paddle acts as the authorised reseller (Merchant of Record) from whom you purchase the product; Paddle collects applicable taxes and issues your receipt. Your purchase may also be governed by Paddle's Buyer Terms and Refund Policy (https://www.paddle.com/legal/buyer-terms).

Prices are shown in US Dollars and may exclude applicable taxes. The final amount charged, including any applicable VAT or sales tax, is shown at checkout.

5. AI Text Assistance

Before final generation, you may use AI text assistance to prepare ideas, lyrics, style, mood, and other song details. Any AI request before final generation counts as one AI text assistance action.

Free users and one-time-pack users receive up to 10 AI text assistance actions per song draft. Active subscribers receive up to 20 actions per draft. Additional actions cost 1 token each.

Cancelling a draft does not reset actions already used. Reasonable technical, daily, and anti-abuse limits may apply.

6. Public and Private Songs; Public Library

Songs generated without an active subscription may be public by default and may appear in the public, searchable song library, where they may be played, shared, and downloaded by other users where those features are available.

Active subscribers may mark generated songs as private; private songs are not shown in the public library. Users without an active subscription may make a public song private for 1 token where this feature is available, or request deletion of a song by contacting support.

By generating a public song you grant Create Your Song the limited, non-exclusive permission needed to host, store, display, reproduce, and distribute that song through the service and its public library. This permission ends when the song is made private or deleted, subject to technical propagation and backups.

7. Ownership and Use of Generated Content

You receive rights to use the outputs you generate to the extent permitted by applicable third-party provider terms and applicable law. Outputs from paid generations may be used commercially where provider terms permit; outputs from free generations may carry more limited rights.

We make no guarantee of ownership, exclusivity, uniqueness, copyrightability, or non-infringement of any output. AI models can produce similar outputs for similar prompts.

You remain solely responsible for any publication, distribution, monetisation, or other use of generated content, and for ensuring that such use complies with applicable law and third-party rights.

8. Acceptable Use

You agree not to use the service, and not to submit prompts or content, to: (a) imitate, clone, or impersonate the voice or identity of a specific real person, artist, singer, or performer, or create output designed to be confusingly similar to a specific artist, band, song, or protected work; (b) reproduce copyrighted lyrics, protected songs, or other third-party content without the right to do so; (c) create hateful, harassing, threatening, or targeted-abuse content; (d) support terrorism, violent extremism, or other criminal activity; (e) run scams, spam, or phishing; (f) violate the privacy or data-protection rights of others; (g) use automation, scraping, or other means to bypass limits, rate limits, or security measures; (h) abuse tokens, subscriptions, payments, the public library, or any promotional mechanism; (i) create illegal or deliberately harmful content; (j) create or facilitate child sexual abuse, exploitation, or endangerment; (k) create sexual exploitation or non-consensual sexual content; or (l) create content promoting or encouraging self-harm.

We may, at our discretion and where appropriate, block or reject prompts, remove or restrict public content, make songs private, delete unlawful or infringing content, and suspend or terminate access, in accordance with these Terms and applicable law.

9. Service Availability, Technical Failures, and Remedies

We aim for high availability but do not guarantee uninterrupted or error-free operation. Generation depends on third-party AI and infrastructure providers and may fail or be delayed.

A technical failure means, for example: no song was generated; files were not delivered; delivered files are corrupted or inaccessible; or tokens were charged although generation did not complete because of a service error.

A technical failure does not include: dissatisfaction with the style, voice, lyrics, or quality of a result; an unsuitable or ineffective prompt; a change of mind; rejection of a prompt that requests prohibited content; or an expectation that the service imitate a particular artist or voice.

Where a technical failure occurs, we will return the tokens charged for the affected generation to your balance, or provide another reasonable remedy. This does not necessarily mean an automatic cash refund; monetary refunds are handled under the Refund Policy.

10. Content Retention and Availability

We do not guarantee permanent storage of generated content. Our intended availability is: while a subscription is active; for users without an active subscription, for at least one year after the last meaningful account activity; and after cancellation, for at least one year after cancellation or the last meaningful activity, whichever is later.

These are intended-availability targets, not an absolute guarantee. We may remove or restrict access to content for legal, moderation, security, or technical reasons.

11. Premium Features, Branding, and Saved Vocal Profiles

Active subscriptions may include premium features such as higher AI text assistance limits, the ability to mark songs private, removal of watermark or Create Your Song branding where available, and the ability to save and reuse eligible AI-generated vocal profiles where supported by the service and third-party providers. The availability of specific premium features may change.

Saved vocal profiles apply only to eligible AI-generated voices created through the service. They may not be used to upload, clone, imitate, or impersonate the voice of a real person. Reused vocal profiles may vary between generations and do not guarantee identical vocal reproduction. Availability depends on technical support and applicable third-party provider terms.

Free users and users of one-time token packs may see Create Your Song branding on cover artwork, public song pages, or other generated or publicly displayed materials. Active subscribers may remove or hide this branding where the option is available. This does not apply to third-party marks or technical metadata outside our control.

12. Subscription Cancellation and Failed Payments

You may cancel a subscription at any time; cancellation stops future renewals. Premium access continues until the end of the period already paid for, and unused subscription tokens remain available for 30 days after cancellation.

If a renewal payment fails, we may suspend premium access and premium features until payment is completed, and we may cancel the subscription after repeated failures.

13. Moderation and Reporting

The service includes content moderation. Users may report public songs or other content. We may review reported content and take action, including making content private, removing it, or suspending accounts, in accordance with these Terms and applicable law.

14. Suspension and Termination

You may stop using the service at any time. We may suspend or terminate access for breach of these Terms, unlawful use, security or fraud concerns, or where required by law.

Where your account is terminated for a serious breach, you may not be eligible for discretionary refunds, without prejudice to your mandatory statutory rights.

15. Third-Party Service Dependencies

The service relies on third-party providers for AI generation, storage, messaging, and payments. Their availability, terms, and pricing are outside our control, and changes on their side may affect the service.

16. Refunds

Token returns or other reasonable remedies for technical failures, and monetary refunds, are described in our Refund Policy. Purchases made through Paddle may also be subject to Paddle's Buyer Terms and Refund Policy.

17. Disclaimers and Warranties

To the extent permitted by applicable law, the service and all outputs are provided "as is" and "as available", without warranties of any kind, including fitness for a particular purpose, accuracy, or non-infringement.

Nothing in these Terms limits or excludes your mandatory statutory rights as a consumer, including rights concerning faulty digital content or digital services.

18. Limitation of Liability

To the maximum extent permitted by applicable law, Create Your Song and its operator are not liable for indirect, incidental, special, or consequential damages arising from your use of the service. Our total aggregate liability for any claim relating to the service is limited to the amount you paid us in the 12 months preceding the claim.

Nothing in this section limits liability that cannot be limited or excluded under applicable law, including mandatory consumer-protection rights.

19. Consumer Rights

If you are a consumer in the EU/EEA or another jurisdiction that grants mandatory consumer rights, you retain those rights. EU consumers generally have mandatory rights regarding distance contracts and faulty digital content or digital services, including certain rights of withdrawal and remedies for non-conforming digital content, which cannot be removed or reduced by these Terms.

Where the service begins immediately with your prior express consent and acknowledgement, your statutory right of withdrawal may be affected in accordance with applicable law.

20. Changes to These Terms

We may update these Terms when the service changes or for legal reasons. Material changes will be announced through the Telegram bot. The "Last updated" date reflects the latest revision. Continued use of the service after changes take effect constitutes acceptance, without prejudice to your mandatory rights.

21. Governing Law

These Terms are governed by the laws of Poland and applicable European Union law. If you are a consumer, you also benefit from the mandatory protections of the law of your country of residence, and this choice of law does not deprive you of those protections.

22. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force, and the invalid provision will be replaced by a valid one that most closely reflects its original intent.

23. Language

These Terms may be provided in several languages. The English version is the controlling version; in case of any conflict, the English version prevails, without prejudice to mandatory rights that require another language.
